Worst Workplace Safety Violations of 2015

The U.S. Department of Labor reported 4,679 fatal work injuries last year, a rate of 3.3 per 100,000 workers. While waiting to see how the rate will change for this year, in this Silk we monitor the employers who have received the biggest penalties in 2015 for safety and/or health violations. 

To reduce injuries and fatalities on the workplace, OSHA can out inspections on employers, either spontaneously or upon receiving complaints. If violations of its safety and health standads are found, the agency can impose a fine. Penalties are relatively mild: maximum $7,000 for a serious violation and maximum $70,000 for repeated or willful violation. In this resource we've included all the 2015 OSHA investigations that resulted in a $40,000+ fine. As of October 21st, there are 553 of such inspections, some affecting the same employer more than once. 

The data is from the Occupational Safety and Health Administration (OSHA), the government agency responsible for setting work safety and health standards, and also monitoring their implementation. It is a subset of the tens of thousands of inspections carried out by OSHA every year (36,163 in 2014 alone).

The two biggest penalties of 2015 are those stemming from the inspections of Ashley Furniture Industries and of Kehrer Brothers Construction.

In both cases OSHA charged the employers with a penalty of more than $1.75 million.

The Ashley Furniture inspection found about 1,000 work-related injuries in a 3-year period. OSHA concluded that, to increase productivity, the company had "intentionally and willfully disregarded OSHA standards and its own corporate safety manuals".  Among the violations found at Ashley Furniture,  some are known to often result in death or permanent disability.

The Kehrer Brothers case revealed that the company "brought non-English speaking workers to the U.S. and knowingly exposed them to asbestos".  What's more, Kehrer Brothers were found guilty of more illegal conduct, like threatening to fire employees if they were to speak with OSHA investigators.

Total Initial Violations isn't the sum of wilful 

In just one inspections, OSHA found that these two companies violated more standards than what it overall found for other companies, targeted by more than one inspections. For example, OSHA charged Kehrer Brothers with 25 willful violations: more than twice the number found in any other case. It found 12 willful violations and 14 serious ones during the Ashley Furniture investigation. This is more than the overall found in many other employers investigated multiple times, like LLyod Industries, or even Dollar Tree Stores, which went through 8 OSHA inspections.

Kehrer Brothers' 25 willful violations stand out even more when compared to the results of the other 552 big OSHA investigations of 2015. Almost two thirds (64%) of all of them concluded with 0 willful violations. And 94% of them, actually, had at most 2 willful violations. Only 0.8% had 10 more more. And the Kehrer Brothers' one is definitely the only one with more than 15 violations.

Roofing contractors are the highest fined industry

OSHA classifies employers by the North American Industry Classification System standard (NAICS). Under this categorization, roofing contractors are the industry that received the overall highest penalties, more than $5.22 million. About a third of this amount is due to the Kehrer Brothers case alone, but even excluding that the industry would still rank first.

OSHA is meant mainly for the private sector, but 32 State and Local Government employers are fined this year
